– We’re with Caroline Taylor. Caroline is a personal
injury attorney in Nashville and she’s agreed to answer our online question
that was posted. This question is related
to statute of limitations. And this question was
posted by Matthew. Matthew says, “My
wife slipped and fell “on a spill at a
grocery store last month “and she is still
struggling with back pain. “We are thinking
about filing a lawsuit “against the grocery store “but how long do
we have to decide?” – Great question, Matthew, and I’m so sorry that your wife is having to deal with this. So, essentially
statute of limitations are what govern
the amount of time that you have to file a lawsuit. If you’re in Tennessee,
which I think that you are, then a general rule of thumb
for personal injury cases is that you nave a year to file from the date of the accident. So that would be
about a month ago with whatever date that is
that your wife actually fell. Now there are exceptions to that and different causes of action require different
filing deadlines. By causes of action I just mean
different types of lawsuits. Different claims that you have are governed by
different time frames. But the majority rule, you know, a good rule of thumb to go by is that you typically
have a year. One thing that I
would suggest to you is that the sooner that
you start investigating and the sooner that you hire
somebody on your behalf, the better. You know, as time goes by
minds tend to start to slip, people forget things, evidence seems to not be quite
as apparent on down the road. So I would tell you,
you know obviously, to really think about this. Make a decision as soon
as you possibly can because the sooner and
the closer to the accident that you can hire somebody, the better that everybody
will be in the end; the better prosecution of
your case that can be done. – Excellent. Well, if you have any other
questions for Caroline just post them in the
comments section below and she’s agreed to get
back to you with answers. So thanks for your
time, Caroline. – Absolutely. Thank you.

Did not get requested medical records for 3 months . Did not discover the negligence in fathers death until I saw those records. If I did not get records until Feb 9th do I have until Feb 9th to file on this matter?
