– Hi. My name is David P. Shapiro. I’m a San Diego sex crimes lawyer and I’m also the owner
and managing partner of the Law Office of David P. Shapiro, and today I want to discuss with you, generally, sex crimes in San Diego. There are few cases, few terms that really affect everyone’s thought process, everyone’s mood, everyone’s fears and concerns when
you hear sex crimes. And for those of you out
there who are charged with or have ever been accused
of committing a sex crime whether you did commit the crime or not, it is terrifying when your livelihood is at stake, when your ability to see
your family is at stake, when your ability to be free is at stake, when you are fearful that you will have to register
as a sex offender possibly for the rest of your life if you’re convicted. Now, sex crimes could
range from misdemeanors, punishable by up to, but not
exceeding, one year in jail, all the way to felonies that can land individuals in jail for the rest of their natural lives. There’re only really a small handful of misdemeanor sex crimes. The large majority of
sex crimes are felonies that do carry some very,
very serious consequences, including state prison commitments. So what is essential? What are some general, key components to think about when you’re charged with, whether it’s you or a loved one, are charged with a sex crime? It is essential, it is absolutely essential, not to speak to the police. Not to fall subject to something
known as a controlled call when the alleged victim calls you or the alleged victim’s parent calls you and says something along the lines of, “Can you just tell me what you did again because my therapist
said that it’s important that we move on” or “If you
tell me I’ll forgive you”, and far too often, cases that
are defendable, quite frankly, cases where the individual
didn’t even actually do what they’re accused of doing, they have a difficult time
defending against them because of what they say to the police, what they say in that controlled call where they say, “I’m so sorry. I feel terrible. I felt terrible
about this for 10 years.” That is the most damning
piece of evidence against you. And I’m not just saying this
because that’s what I think. It’s that’s what I’ve
lived through representing hundreds of people accused of sex crimes, trying numerous sexual assault offenses, taking these cases to trial, speaking to jurors afterwards where they’ve told me, “If it weren’t for your
client’s own admissions on that controlled call, or the way he spoke to police, we would not have had enough
of evidence to convict him. Doesn’t mean we didn’t think he did it, just means we don’t
think the case was proven beyond a reasonable doubt.” I also authored a book on the topic. It’s a survival guide for those people accused of a sex crime. There’s an available
