of this bill thank you madam Speaker I call Hamish Walker five minutes firstly I’d like to start by congratulating the two the two marks the Honorable mark Mitchell and the Honorable Ron mark just shows what can actually happen the positivity of this place if we all work together national supports this bill this bill was introduced in August and involves significant improvements to the military justice system now one of the most important of these I believe is the incorporation into the military justice system of the victim rights under part three of the victim Rights Act 2002 this will ensure that victims of specified offenses have rights and protections in the military justice system they’re basically equivalent to those that they would receive in the civilian system this bill also repeals a provision of the Armed Forces act 1971 that places the onus of proof for defense of a specific charge onto the accused now this bill also it means some aspects of the procedure of the court-martial of New Zealand and I believe these developments will only improve the military justice system I just want to bring your attention to Clause 4 which repeals section three two of the Princeville Act section three two is concerned with the onus of proof and circumstances where an accused who has charged with an offense seeks to establish as a defense an excuse exemption or qualification contained in the provision those circumstances section three two means that the prosecution although in some situations the accused may still have to raise an evidential foundation for the existence of the defense I think this is the right right choice and once again commend to that – marks the right honorable mark Mitchell and the minister Ron mark for pushing this bill through I call our whistle wall de NOC we did a quick cure done tomorrow LT funny
