How do I know if Canada’s Anti-spam legislation applies to my business or organization? The law creates new requirements that apply to commercial conduct. For example, there are requirements about sending commercial electronic messages to an electronic address, such as sending email or text messages. If your business or organization sends commercial electronic messages, there are three new requirements you must follow in order to comply: 1. Consent. ‘You must have express or implied consent to send a commercial electronic message’ 2. Identification. ‘You must clearly identify yourself and the business or organization sending the commercial electronic message’ 3.
